DMCA Policy

1. Overview
KidoGames.in ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. 2. Filing a DMCA Takedown Notice
To file a DMCA takedown notice, you must provide a written communication to our designated DMCA agent that includes substantially the following information (please consult your legal counsel or refer to Section 512(c)(3) of the DMCA for further details):
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works at a single online site are covered by a single notification, provide a representative list of such works at that site.
- Identification of the infringing material: A description of the material that you claim is infringing and that you request to be removed or access to which you request to be disabled, along with information reasonably sufficient to permit us to locate the material. Providing the specific URL(s) of the page(s) containing the infringing material is the most effective way to help us locate the content.
- Your contact information: Your name, mailing address, telephone number, and email address so that we may contact you regarding your complaint.
- Statement of good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
3. Counter-Notification Procedure
If you believe that the material that was removed or to which access was disabled is not infringing, or that you have authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a counter-notification to our designated DMCA agent containing the following information:
- Identification of the material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled (the URL is preferred).
- Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your contact information: Your name, mailing address, telephone number, and email address.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the applicable court in your jurisdiction if outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Signature: Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward it to the original complaining party. The original complaining party will then have ten (10) business days to notify us that they have filed a court action to restrain the allegedly infringing activity. If we do not receive such notice within that period, we may, at our discretion, restore the removed material or cease disabling access to it.
4. Repeat Infringers
In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, access for users or content providers who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Site and/or terminate access for any user who infringes any intellectual property rights of others, whether or not there is any repeat infringement.
5. Important Notes
- Good Faith Requirement: Please be advised that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
